The juftices of the peace for the county of Kinofs, have convicted two perDas of the offence of illegally diftilling pirits; when their ftills, utenfils, &c. were condemned as forteited, and each disquent fined in the fum of one bunared pounds.

The justices of Renfrewshire have a warded fines against private diftillers in La dittnct to the amount of 5421.

The Court Martial which has been fitting for the last three weeks at Sheerres, on the mutineers of the Defiance man of war, when lying in Leith roads, terminated on Thursday, when, of the fventeen unfortunate and deluded men, Line were ordered to be hanged, fix to native corporal punishment, and two were acquitted.

The Louis d'or, on the 16th, was worth in afignats fix hundred thoujand Ires.

On Wednesday the 24th failed from Berwick the Union and Roxburgh packfaw a brig cutter; at half paft two A. M. he fired a gun, a fignal to bring to; the veffels wore immediately and bove up to her; fhe being a very little ditance off, found it impoffible to get from her: She then fent a boat on board, and took poffeffion of the veffels, and and made the crew and paffengers priloners. After taking fome part of the cargo cut of the Union, they fcuttled her and fhe went down. At three o'clock P. M. the Roxburgh, we understand was font to Dunkirk. Parting with the Roxburgh, fhe went in chafe of a brig; coming up with her, the cutter fired a gin; the then brought to under Danish colours. Being a neutral ship, the Captain of the cutter fent the paffengers belonging to the above captured fhips on beard the Dane, excepting three foldiers; I was bound to the Frith of Forth.The paffengers were landed yesterday at Newhaven.

The Duchefs York of Leith for London was captured by a Flushing privateer on the 20th. She had on board 100 recruits of the royals and 42d, fhe is carried to Ofterd.

From various accounts it appears, that there are a number of privateers crifing on the east coast.

This morning the Lord Provoft recived intelligence that the privateer, which captured the two Berwick fmacks, was feen off that port yefterday morning at 3 o'clock, engaging a British cutter VOL. LVIII.

(the Star brig of 14 guns)-and that another veffel (fuppofed to be the Weafe! floop which had failed from Shields) was bearing down.

From Alnwick advice is received, that on the 26th, there was a fhip fet on fire laft night just off Coquet Inland, by a French privateer which took the crew prifoners, but fet two women on fhore near Shields. The privateer is still in fight.

There are now in circulation a number of counterfeit guineas and half guineas which cannot be detected by weighing them, as they are confiderably above the ftandard. But which upon clofs examination, though well executed, will be found deficient in the milling-Larger than the real coin, of a lighter colour, bearing date 1790.

The very laudable excrtions making by the Highland Society to improve agriculture in the Highland diftricts of Scotland, cannot fail of being attended with the happiest effects. By holding out premiums, they are exciting the attention of the inhabitants in these diftricts to improve the breed of Highland horfes and black cattle-the proper construction of farm-houfes and offices-the best method of cafting peats and preferving moffes-the prefervation of potatoes in all feafons, and the improving and raifing them on ground hitherto not cultiva ted-as alfo the cultivation of madder.

APPEALS,

Lindsay. Kinloch; after Lord Thurlow had given his opinion, he concluded by moving, that the last interlocutor of the Court of Seffion be affirmed, all former interlocutors reverfed, and the defendant affoilzied from the claim.

On Wednesday the 23d counfel were heard in the Houfe of Lords on the appeal from Scotland, in which Mifs Ka tharine Mercer, eklett daughter now alive of the late Colonel W. Mercer of Aldie, appellant; and Sir John Ogilvie of Invercarity, Bart. Hope Stewart of Ballechin, Efq. and Mifs Margaret Elphinstone, daughter of the Hon. George Keith Elphinstone, and the faid George Keith Elphinflone, her adminiftra or in law, refpondents. The Lords have af firmed the decree of the Court of Seffiou.

The month of February has continued fresh and mild for the feafon. The farmers have got their labour very far advanced, and are wishing for a little froft to check vegetation, which is rather coming on too rapidly. The thermometer has ranged from 39 to 49 in the fhade, during the day.-Though showery, there have been no ferious rains.-Markets, fince laft month, have been a little on the rife, though not much.-Potatoes have got up to is. per peck.-Herrings are ftill in plenty.-Butter 18. per pound, -Eggs 6d. per dozen.-Abundance of fish almost every day.

for enabling the magiftrates in the several counties in Great Britain to raise and › levy, under certain regulations, fuch ablebodied and idle perfons as fhall be found within the faid counties, to ferve in his Majefty's Navy," the magiftrates in the burgh of Dumfries having, on the 9th of June laft, iffued a warrant to their officers and conftables to fearch for and apprehend all able-bodied, idle, and diforderly perfons, who could not, upon examination, prove themselves to exercife and induftrioufly follow fome lawful trade or employment, or to have fome fubftance fufficient for their fupport and maintenance, and to bring them before the faid magiftrates, in order to be examined and dealt with as the faid act directs and thefe officers and conftables, accompanied by a party of the firft fencible regiment, having proceeded to the house of the said John Oniel, aud having knocked at the door, and defired admittance, it was refufed by the faid John and Arthur Oniel, who declared their refolution to fhoot the first perfon who fhould enter the houfe; that the faid conftables and party having informed them of the prefence of the peace of ficers, and repeatedly remonftrated on the impropriety of refiftance, proceeded to force open the door, when the faid John and Arthur Oniel did both, or one or other of them, fire three guns, loaded with lead drops and flugs, or fmall bullets, from the infide of the house, upon the faid officers of the law, and party affifting them, by which John Grant, a private in the faid firft fencible regiment was feverely wounded in both his legs, in fo much that one of them was obliged to be amputated; and who, after languifhing for a confiderable time in the infirmary of Dumfries, died in confequence of the wounds he had fo received. Serjeant Beaton, Alexander Frafer, and John Cuming, of the fencibles, and Robert Howat, conftable, were likewife wounded.

The Jury returned their verdict on Tuesday after the rifing of the Court of Seffion, all in one voice finding John Oniel ilty, but finding, in like manner, the libel, not proven, as to Arthur Oniel, who was of consequence, dismissed from the bar.

The Court fentenced John Oniel to be hanged at Edinburgh on the 9th of March next, and his body to be given to the furgeons.

The English report for January states, that the continuation of rains and warm weather throughout the month, has proved unfavourable to the growing plants of wheat in general, by increafing the worm and flug, and forcing the vegetative powers of the foil at an untimely feafon. Early feeding, and trading them with fheep, have been found more than ufually fuccefsful throughout the winter. Oats, barley, pease, and beans, are fortunately found to rife from the flail more abundantly than was at first expected; but the preffing recommendation of the legislature has produced but few inftances where the meal from any of these is mixed with wheaten for general confumption. Bean dibbling, and drilling of white peale, have commenced on many diy foils; but the broad caft fowing is retarded by the wetness of the feafon. The ftrong lands raised for fallows, are much chilled by the inceffant rains, and will crofs badly in general, for want of dry winds, ar a meliorating froft. The young clovers fhew well, though but few of them have received their intended dressings of manure. Rape ftanding for crops looks kindly, and is grown this year to a-larger extent than ufual, Lean cattle of all kinds are ftill fcarce. Smithfield has received of late but a fhort supply of beef or Mutton of the prime kinds; the former is now worth 4s. the latter 58.* per ftone, and fink the offal. The early flocks of Dorfet and Wiltshire have had a favourable lambing season, and twin-ned more than ufual. Hay continues reasonable, except in the vicinity of the new barracks for cavalry. Horfes of alt kinds are further reduced in price.
