It was agreed to delay intimating the fentence till next day; and the Moderator, Prof. Hamilton,, and Meff. James Nafinyth, John Hyndman, and Jofeph Williamfon, were appointed a committee to confer with the prefbytery of Dalkeith next morning in the Society-hall.

Next day Meff. James Stevenfon, Robert Walker, John Warden, John Johnfton, William Orr, David Spence, and William Tait, adhered to the aforementioned diffent. -Then the committee reported, That they had converfed at great length with the presbytery of Dalkeith; but that that prefbytery feemed to think themselves obliged to appeal to the affembly. The prefbytery fat Tome time after the conference, and then gave in a paper to the fynod; in which they fay," they are of opinion, that if the refolution of the fynod, which as yet is not intimated to them, fhall have confidered them as parties, and have condemned their conduct, in forming and carrying on a libel against Mr Car lyle, that they are, according to the forms of this church, at liberty to ap peal to the general affembly;" and they appointed their moderator to enter an appeal accordingly, for reafons to be gi ven in due time.Then the fentence was intimated. The prefbytery appealed. Mr Carlyle faid, "He received the admonition and injunction of the fynod with respect. He was forry for the offence he had given; and hoped he should never give the fynod, or any other judicature of the church, occafion to call him be fore them again for fuch a piece of conduct." Meff. Thomas Turnbull, Wil liam Mackie, Patrick Simfon, John Murray, and Robert Paton, minifters in Dalkeith prefbytery, defired it might be marked that they acquiefced in the fynod's fentence. The fynod appointed the Moderator, Prof. Hamilton, and Meff. Robert Wallace, William Robertfon, and Gilbert Hamilton, and Mr Jofeph Williamson, a committee to an

fwer the reasons of the appeal and diffent when given in; and, in conjunction with others of the fynod who are members of the enfuing affembly, to fupport the sentence of the fynod before that court.

On the 13th the following overture was tranfmitted to the affembly. "The fynod being deeply affected with the countenance given of late to the enter tainments of the ftage, particularly by feveral minifters, which entertainments have from long experience been found prejudicial to the great interefts of religion and virtue; and confidering that it has been alledged, that there is no exprefs law or ftatute of this church which prohibits her members and ministers to witnefs theatrical reprefentations, they do humbly overture to the Venerable Affembly, that they would be pleafed to take this matter under their serious confideration, and lay down fuch rules as fhall obviate that pretext, and may effectually prevent fuch unwarrantable practices for the future."

[We are greatly obliged to thofe who favour us with accounts of judicial proceedings in remarkable cafes; and fhall always think ourselves vouchers, to fupply omiflions or rectify mistakes; no lefs obliged to thofe who enable us, by proper though we have reafon to believe there are no material errors in the accounts we now publish.]

The Jeune Louife, from St Domingo, cut out of Bourdeaux harbour, and carried into Portfmouth, by a small privateer of Guernsey.

By the Charming Nancy of Jerfey, Winter: A French privateer of 6 carriage-guns, 14 fwivels, and 50 men; a floop with wheat and peafe; a brig from Bourdeaux for Nantz, with wine and flour, and 6 twelve-pounder guns and two anhams, pitch, oars, &c. on the King's account; chors for a privateer; and a bark with fine wines, all carried into Jerfey. She alfo run afhore three fhips from St Domingo near Bourdeaux, out of one of which the took 50 or 60 hogfheads indice. They all three funk. She likewife ranfomed a brig for 150l. and retook a brig loaded with cheese. All this was performed in a cruise of three weeks. She afterwards retook the Faro Packet, Mercer, from London for Faro.
